2018 saw the declassification of hemp from a scheduled substance to a food additive. This effectively legalized CBD but created confusion among its member states, limiting its distribution and use.

The hemp plant has a variety of uses, but with the recent advances in research, its extracts, especially its cannabinoids, have been found favorable for medical purposes. CBD is different from hemp seed oil in that CBD is mainly obtained from the whole plant except for its seeds, whereas hemp seed oil is mainly derived from mature seeds of the hemp plant. CBD has numerous health benefits, such as reducing the effects of certain mental illnesses such as Alzheimer’s, stress, and insomnia. CBD is useful for combating skin issues such as acne, psoriasis, pain, and inflammation. CBD mainly interacts with the body through the endocannabinoid system, widespread throughout the body. This system works with the central nervous system to modulate various body functions, such as the production of hormones by the brain. However, getting CBD can be tricky as the federal government has allowed each state to develop its laws regarding the sale and use of CBD. This varies as there are numerous products of CBD, as shown below.

Types of Hemp Extracts

CBD is mainly obtained from hemp in the form of oils categorized as either full spectrum, broad-spectrum, or CBD isolates. These extracts are then used to make the various CBD products available such as topical products. Oleinik (2021) stated that CBD tinctures are usually placed under the tongue, edibles in the form of cookies, gummies, and other oral products such as capsules and pills. These are discussed below as follows:

CBD Isolate

A cannabidiol isolate is a cannabidiol separated from other hemp and marijuana-related chemicals. CBD isolate is the purest form of CBD available and is free from other cannabinoids or chemical substances in the cannabis plant. This is made possible through an extraction procedure that eliminates all plant components except CBD. According to Dtta et al. (2018), high-quality CBD isolates are frequently more than 95% pure, depending on the extraction method. One major benefit of CBD isolate is its purity, which allows it to retain its efficiency even when coupled with other substances such as gummies and cookies.

Full-Spectrum CBD

A full-spectrum CBD oil product is made from the entire hemp plant. This entails pulverizing or pressing the plants’ roots, stems, flowers, and leaves to extract the oils. This results in a full spectrum of cannabinoids (CBD, CBG, CBN, and THC), terpenes (limonene and myrcene), and other plant phytochemicals such as chlorophyll and organic matter. The resulting oil is dark in color and has a strong earthy flavor. However, as much as THC may be present, it is found in low concentrations of less than the approved 0.3 percent. According to Ferber et al. (2020), CBD oil is suitable for individuals who want to experience the entourage effect caused by the compounds in full spectrum working in synergy.

Broad-Spectrum CBD

Broad-spectrum CBD is made using the same process as full-spectrum CBD oil; the leaves, roots, stems, and flowers are used in the extraction process. The distinction is that the compound, THC, is separated and eliminated during extraction. Beyond CBD, there exists a wide spectrum of cannabinoids to choose from. Due to the legal nature of THC, it may not be easy to acquire broad-spectrum CBD, which contains more than 0.3% of THC. Takano & Dayan (2020) noted that a true broad-spectrum product would include no trace levels of THC. It will provide a comprehensive cannabinoid profile that includes CBD, CBG, CBN, CBDV, and terpenes. This makes it suitable for individuals prone to frequent drug tests or found in states where THC is prohibited but still want to experience the entourage effect.

Can CBD Oil Get You High

CBD interacts with the body through the endocannabinoid system through the various receptors that can bind to CBD. The endocannabinoid system is a widespread neuromodulatory system involved in central nervous system development, synaptic plasticity, and the response to endogenous and environmental insults. The ECS comprises cannabinoid receptors, endogenous cannabinoids (endocannabinoids), and the enzymes responsible for endocannabinoid synthesis and degradation. CB1 cannabinoid receptors are the most abundant, but cannabinoids also engage CB2 cannabinoid receptors, transient receptor potential (TRP) channels, and peroxisome proliferator-activated receptors (PPARs). CBD mainly interacts with TRP and PPAR receptors responsible for linking various endocannabinoid receptors, particularly the CB1 receptor, which is highly concentrated in the brain. Unlike THC, CBD promotes the connection between these receptors, even though it has a low affinity for them compared to THC. This enhancement makes it suitable for rerouting signals in the brain, especially for people with various psychological disorders. This enhances the optimized production of various hormones such as serotonin, dopamine, and cortisol, which affect the mood, attitude, focus, and levels of stress in the brain. CBD promotes optimal responses by body organs in different environmental conditions, e.g., CBD, through the receptors above, controls the secretion of sebum, which, when overproduced, would lead to the formation of spots and eventually acne in extreme cases.

THC, unlike CBD, has a high affinity for CB1 and CB2 receptors. THC has chemical and structural properties similar to anandamide, an endogenous enzyme the ECS utilizes to modulate connections between ECS receptors. In particular, THC has numerous lipophilic structures with a high affinity for these receptors. Thus, THC binds to these receptors, especially with CB1 receptors, which are numerous in the brain and found in the areas responsible for mood, memory, locomotor functions, and attention. Thus, binding to receptors in this region inhibits neuron signals transmitted from one neuron to another. This leads to slowing down of brain activities, thus creating a euphoric feeling for the user. Therefore, CBD cannot make one high as it binds to different receptors than THC. CBD has the opposite effect to THC, as it is antipsychotic; therefore, as THC inhibits receptor connection, CBD enhances these connections when used together.

CBD Laws In Kentucky

Kentucky has some of the strictest marijuana restrictions in the country, including for those who use it for medical purposes. Although several states have made headway in easing their restrictions on cannabis use for medical and recreational purposes, Kentucky views marijuana possession and sales as a criminal offense. The legality of cannabidiol, however, depends on where it comes from because it can be made from the hemp or marijuana varieties of the cannabis plant. Hemp-derived Cannabidiol, as opposed to CBD oil generated from marijuana, is entirely legal in Kentucky. Industrial hemp-derived cannabis extracts are lawful under the Farm Bill of 2018 as long as they contain less than 0.3% THC. Unless a state’s laws specifically prohibit it, the 2018 Farm Bill enables the possession and sale of all CBD products derived from hemp. Kentucky doesn’t have any laws restricting CBD oil made from hemp. Therefore, as long as the CBD oil is derived from hemp, purchasing it in Kentucky is legal.
